The Securities and Exchange Commission on Tuesday amended its complaint against Richard Lee, a former portfolio manager at SAC Capital Advisors who the agency charged on July 25 with insider trading, to additionally charge Sandeep Aggarwal, the tipper of confidential information to Lee.

The SEC says that Aggarwal, a sell-side analyst, tipped Lee in advance of a July 2009 public announcement about an Internet search engine partnership between Microsoft and Yahoo.

Lee purchased large amounts of Yahoo stock in the SAC Capital hedge fund that he managed as well as in his personal trading account on the basis of the inside information.

In a parallel action, the U.S. Attorney’s Office for the Southern District of New York on Tuesday announced criminal charges against Aggarwal, who lives in India but recently returned to the U.S.

Sanjay Wadhwa, senior associate director of the SEC’s New York Regional Office, said in a statement that “Rather than rely on legitimate research methods, Aggarwal obtained confidential information from a close friend at Microsoft and passed it along to Lee knowing that he would likely trade on it.”

    2013 has been a pretty strong year for Corning (GLW). Since the calendar flipped over to January, this $22 billion glassmaker has seen its shares rally more than 20%. And from a fundamental standpoint, I think that Corning still looks pretty attractive. But the technicals are telling a different story right now -- and investors would do well to listen.

    That's because Corning is currently forming a descending triangle pattern, a price setup that's formed by a downtrending resistance level above shares coupled with a horizontal support line at the $14 level. Basically, as Corning bounces between those two technical prices, it's getting squeezed closer and closer to a breakdown below $14. When that breakdown happens, it's time to sell this stock.

    Corning spent yesterday's session testing the top of resistance, a move that could potentially break the pattern. If that happens, the pressure's off this stock. But I think it's too early to call this bearish pattern kaput. Buyers looking for an entry should wait to see if! Corning ! can still catch a bid first.

Top Up And Coming Companies To Own In Right Now

More than two years ago, I identified 10 companies that I would be putting $40,000 of my own retirement money behind. This was, has been, and will continue to be my way of helping the world to invest better.

    Basic guidelines
    In this series, I examine inventory using a simple rule of thumb: Inventory increases ought to roughly parallel revenue increases. If inventory bloats more quickly than sales grow, this might be a sign that expected sales haven't materialized. Is the current inventory situation at Brunswick (NYSE: BC  ) out of line? To figure that out, start by comparing the company's inventory growth to sales growth. How is Brunswick doing by this quick checkup? At first glance, not so great. Trailing-12-month revenue increased 3.0%, and inventory increased 8.4%. Comparing the latest quarter to the prior-year quarter, the story looks decent.     We can glean a few clear trends from these share buybackers:

    The majority of these plans are simply new plans to replace old plans that have now been completed, meaning these companies buy back their shares on a regular basis. Many of these stocks are valued right near the market multiple of 15 to 16 times projected earnings. Many of these stocks offer up a decent dividend as well, boosting their total cash return to shareholders. Most of these buyback programs represent a meaningful amount of the current share count. (Both VMWare's (NYSE: VMW) and Emerson Electric's (NYSE: EMR) buyback programs are not really meaningful as they are only likely large enough to offset stock option grants). Most of these stocks are near their 52-week highs, extending the theme of the current era that companies no longer wait for their stock to fall out of bed before buying back stock. Nor do any of these stocks trade below tangible book value, which also had historically served as a key litmus test of buyback efficacy. 

    Still, the longer-term buyback programs for some of these firms have surely been impressive. Take toy maker Hasbro (NYSE: HAS) as an example. The company's new $500 million share buyback (which would reduce the share count by 11% at current prices) is reasonably impressive -- until you look at what Hasbro has already been doing for nearly a decade.

    But one big element pushing Splunk's stock higher was the buyout offer that rival BMC Software (NASDAQ: BMC  ) received earlier this month. A group of private investors that includes Bain Capital made the $6.9 billion offer for BMC, and with activist investor Elliott Management having blessed the deal, it's likely to go through. The strategic move establishes the value of companies in the data-analytics space, especially given that BMC had already lost its competitive edge against Splunk and other rivals.

Coined the "most social Asha yet," Nokia's (NYSE: NOK  ) latest Wi-Fi-compatible Asha 210 phone includes the mobile industry's first WhatsApp button, the company announced today. In addition to the dedicated WhatsApp feature, the device is available with either single or dual SIM variants, a QWERTY keyboard, and a pre-loaded YouTube launcher.

It comes equipped with a 2MP camera and built-in voice function to help users center images, including self-portraits. Timo Toikkanen, Nokia's executive vice president for mobile phones, said, "The Nokia Asha 210 really stands out giving super-social consumers new ways to express their personalities through design, colour and innovations like the world's first WhatsApp button." The phone also includes ready access to Facebook and Twitter.

The Asha 210�will be introduced in emerging markets including Africa, the Middle East, and parts of Europe. Nokia estimates the retail price will be $72, and it should begin shipping in the second quarter of 2013.

The company board approved a rights offering of up to 40 million shares of Sears Canada. Chairman and CEO Edward Lampert plans to fully exercise his subscription rights. ESL Investments , of which Lampert is also chairman and CEO, will do the same. Sears will still hold about 12 million shares of Sears Canada, valued at about $113 million. The retailer, based in Hoffman Estates, Illinois, expects at least $168 million in proceeds from the rights offering in mid-to-late October, with the rest by early November. Sears Holdings (SHLD), which runs Kmart and its namesake stores, has faced mounting pressure from rivals like Walmart Stores (WMT), in what has proved to be a slow recovery from the recession.     From a technical perspective, VIPS soared sharply higher here right off some near-term support at $42.50 with heavy upside volume. This move pushed shares of VIPS into breakout territory, since the stock took out some near-term overhead resistance levels at $45 to $45.27 with high volume. Shares of VIPS are now quickly moving within range of triggering another big breakout trade. That trade will hit if VIPS manages to take out Monday's intraday high of $48.40 and then once it clears its all-time high at $50.43 with high volume.

    Traders should now look for long-biased trades in VIPS as long as it's trending above $45 and then once it sustains a move or close above those breakout levels with volume that hits near or above 645,972 shares. If that breakout triggers soon, then VIPS will set up to enter new all-time high territory above $50.43, which is bullish technical price action. Some possible upside targets off that breakout are $55 to $57.

The e-commerce juggernaut pulled off a record initial public offering in September when it raised $25 billion on the way to becoming a public company. Analysts love Alibaba. They were able to initiate coverage on Wednesday, following the 40-day quiet period that follows an IPO's debut. Only one of its underwriters -- Goldman Sachs -- failed to tap it as a buy recommendation. It's easy to see the appeal. Alibaba helped 231 million active buyers place 11.3 billion orders totaling $248 billion in transactions last year, and it's just getting started. However, the stock, with its nearly $250 billion market cap, isn't cheap. Let's look at some Chinese dot-coms that have been trading longer and could be more compelling bargains. Baidu (BIDU) China's leading search engine posted another blowout quarter on Wednesday, just as analysts were gushing all over Alibaba. The company behind China's largest search engine saw revenue soar 52 percent over the prior year's third quarter. Earnings climbed just 27 percent, but that was twice as fast as analysts were expecting. Baidu is investing in low-margin online specialties including travel, video and mobile app storefronts, and that weighs on bottom-line growth. Baidu remains one of China's biggest winners. It went public nine years ago at a split-adjusted price of $2.70, and now it trades north of $200. Baidu fulfills roughly two-thirds of all queries, and it is rocking at a time when its profitability is still suppressed. 51job (JOBS) Matching employees to potential hires started out with old-school tech for 51job. Buying stock in a company like Alcoa (NYSE: AA  ) is no sure thing, as the aluminum giant has struggled over the last few years against the global economic malaise and heightened competition from state-backed entities in China and elsewhere.

The consequences of these trends have been twofold. First, the company's earnings per share have plummeted since the financial crisis. According to Finviz.com, the figure has fallen an astounding 44%. Only Bank of America�even comes close in this regard with a contraction of 40%. And secondly, the market has turned particularly bearish on Alcoa stock. As you can see in the figure below, a full 6.47% of its outstanding float is currently sold short -- meaning that traders are betting it will go down. This gives Alcoa the disagreeable title of most shorted stock on the Dow Jones Industrial Average (DJINDICES: ^DJI  ) .

Does this mean that Alcoa stock is headed down? Not necessarily. In fact, it could well be indicative of a fierce ascent in the future if short-sellers have to cover their positions simultaneously. But either way, the impetus must come from Alcoa itself. In the first quarter of this year, for example, while the company beat expectations on the bottom line, it missed on top-line revenue estimates. For any type of short-squeeze situation to materialize, it will have to beat on both. For either current or prospective investors in Alcoa stock, in turn, the most important thing is simply to know where it stands in the market.

    The fact that more young people have chosen not to carry balances and pay high interest rates for unnecessary loans is an unqualifiedly positive result.
